 Description of legal services and terms

legal services and terms There are a variety of legal professionals on in Mallorca. Here we tell you the Spanish/English equivalent and give a brief description. Use the search engine above to find lawyers, accountants etc in Mallorca.

Abogado

(Lawyer): There are numerous occasions where you may need the use of an abogado or lawyer. These include real estate purchase, starting your own business, making a will and investment opportunities.
The best way to find a lawyer would probably be by referral. If a friend recommends someone then the chances are they will do a good job for you.

In the case of real estate your agent will be able to recommend a professional specialising in property conveyance.

Many of the lawyers in Mallorca speak English and German.

It is important to find someone who has a good knowledge of your local language to save costly mistakes!

Asesor Fiscal

(fiscal adviser or chartered accountant): If you are in a situation where you need to pay tax, be it from investments, business or income, then you should consult an asesor fiscal. They can save you money and ensure that you are keeping up with the endless (and forever changing) tax laws. An asesor fiscal can act as your fiscal representative. If you own more than one property you must name a legal representative.

Notario

(Notary or public official): A notario is needed when things have to be officially registered. This includes wills, purchase agreements, pre-nuptial agreements and other contracts. You pay a fee for the service but a notario cannot replace a lawyer or accountant. Fees are fixed by law.

Administrador de Fincas

(property administrator): There are several services and companies around which act as administrators for your property. An administrado de fincas is a licensed professional who will take care of all administration aspects, including paying taxes and managing rental income. They can also be your representative at owner’s meetings.

Contable

(accountant) A contable is the equivalent to an English accountant and can prepare and submit your business accounts, tax returns etc.

Gestoria or Gestor:

There is no real translation into English for this role. A gestor is used to bridge the gap between the public and administrative body. A gestor is usually the first person you will go to in Mallorca when needing assistance. Fees are not cheap but the time and heartache that can be saved from using the services of a gestor are worth the cost, especially if you are new to the island and have a lot of red tape to cut through.

Not all gestors are licensed professionals. As usual, it is better to deal with someone who has been recommended to you. Again it is advisable to find someone who speaks your local language TO A GOOD STANDARD. This ensures that you can understand exactly what they are doing on your behalf and they can follow your instructions clearly.

 Making a will in Mallorca, Spain

making a will Property owners in Spain should have a Spanish will; a foreign will causes many complications and delays which you can avoid. It is always advisable to consult a lawyer (abogado) in these matters before registering the will.
When you receive your copy it is recommended that you send another copy to your embassy as this could save valuable time in the long run.
A will can be drawn up by a notary and costs approximately €60. (2008 prices). If you do not have a will registered at the Registro de Actos de Ultima Voluntad then it is possible that your property could end up with the local or regional government.
